Using Tu Tike (hereinafter, “the Platform”) implies full and unconditional acceptance of these Terms and Conditions (hereinafter, “Terms”), so it is recommended to read them carefully before accessing or using our services. If you do not agree with any of the terms, you should refrain from using the Platform.
By accessing, browsing, or using the Platform in any way, whether as an end user (customer) or as a representative of an integrated restaurant/business, you expressly and unconditionally accept these Terms, as well as any updates that may be made in the future. The Platform may modify these Terms at any time; the current version will be published on our website and will be considered accepted by the user if they continue to use our services.
For the purposes of these Terms, the following terms are defined as:
- Platform: The software and online services provided by Tu Tike for managing restaurant and event reservations.
- User: Any person who accesses and uses the Platform, either to make a reservation or to manage it through an account.
- Integrated Restaurant/Business: The establishments that have joined the Platform to offer reservation services.
- Reservation: The process through which a User requests a table at a restaurant or a reservation for an event via the Platform, which must be confirmed by the establishment or event administrator.
- Account: The personal registration that the User or the Business representative must create to access additional features of the Platform.
- Content: All information, comments, images, and other data posted or transmitted by Users and/or Businesses through the Platform.
Access to and use of the Platform is conditioned on the User being over 18 years of age and having the legal capacity to enter into contracts. If a representative of a business creates an account, they declare having the necessary authorization to act on behalf of the establishment.
- Registration: To access certain features (such as making reservations or managing restaurant information), creating an account is required. The User agrees to provide truthful, complete, and updated information.
- Security: It is the User's responsibility to maintain the confidentiality of login data (username, password, etc.) and to immediately notify any unauthorized use or suspicion of a security breach.
- Responsibility: Everything done with the registered account is the sole responsibility of its owner.
The Platform offers an online reservation system that allows Users to:
- Search and check the availability of tables in affiliated restaurants.
- Make reservations directly and manage their reservation data.
- Receive confirmations, reminders, and notifications related to reservations.
- Reserve tables or seats for available events.
On the other hand, Businesses join the Platform to:
- Manage and confirm received reservations.
- Update relevant information (hours, capacity, menu, etc.) that is of interest to Users.
The Platform acts as an intermediary between the User and the Business; therefore, the confirmation of the reservation is subject to the availability and internal policies of the Business.
- Reservation Process: The User can make a reservation through the Platform, the Website, or the business’s Google profile, depending on the integration type selected by the business, by entering the requested information. Once the request is submitted, the Business will receive the corresponding information for validation.
- Confirmation: The reservation confirmation will depend on the Business's availability. The Platform does not guarantee the automatic acceptance of all requests.
- Modifications: Any modifications or cancellations to the reservation must be managed directly through the Platform, following the cancellation policies set by each Business.
- Cancellations: Cancellations must be made according to the specific policies of each Business, which will be communicated to the User during the reservation process.
- No Show: If the User does not show up at the Business without prior notice, the Business may apply charges or penalties according to its policies, without the Platform assuming any responsibility.
- Modifications: Any request to change the reservation must be communicated as soon as possible. The acceptance of modifications is at the discretion of the Restaurant.
At TuTike, our priority is to facilitate access to the best events and experiences. By purchasing a ticket through our platform, you accept the following conditions:
- Service and Management Fees: Service fees and platform commissions charged at the time of purchase are non-refundable, as they correspond to the technology intermediation service already provided by TuTike.
- Event Cancellation: If an event is canceled or postponed by the organizer (Venue/Restaurant), the customer will be entitled to a refund of the net ticket value and applicable taxes. TuTike will facilitate the refund process once the organizer authorizes and provides the necessary funds.
- Date Changes: In case of rescheduling, the ticket will be valid for the new date. If the customer cannot attend the new date, they must request a refund within a maximum period of 48-72 hours after the change is announced.
- No-Show: No refunds will be issued for customer non-attendance or errors in ticket selection once the purchase is completed.
- Refund Process: Once approved, the refund will be processed through the original payment method (Stripe) and may take between 5 to 10 business days to be reflected in your account, depending on your banking institution.
The User agrees to:
- Use the Platform legally and in accordance with these Terms.
- Not provide false or misleading information during the registration or reservation process.
- Respect the rules and policies established by the Restaurants regarding their reservations.
- Refrain from performing activities that may damage, disrupt, or overload the Platform or affect the experience of other Users.
It is expressly prohibited to:
- Engage in activities that harm the integrity or functionality of the Platform.
- Post or transmit content that is offensive, defamatory, illegal, or infringes on third-party rights.
- Use the Platform for unauthorized commercial purposes or purposes not covered by these Terms.
Failure to comply with these obligations may result in suspension or cancellation of the account, with no right to a refund or compensation.
- Reserved Rights: All intellectual and industrial property rights related to the Platform, its content, interfaces, designs, texts, graphics, and other elements are the exclusive property of Tu Tike or its licensors.
- Limited Use: The User does not acquire any rights over these elements, except for the limited and non-exclusive right to use the Platform in accordance with these Terms.
- User Content: The User retains ownership of the content they post, but grants Tu Tike a non-exclusive, transferable, and sublicensable license to use, reproduce, and distribute such content as part of the Platform’s operation.
- Disclaimer of Warranties: The Platform is offered 'as is' and 'as available.' Tu Tike does not guarantee the accuracy, reliability, or suitability of the information and services offered.
- Limited Liability: Under no circumstances shall Tu Tike be liable for direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform, including but not limited to data loss, service interruptions, or commercial damages.
- Intermediation: Since the Platform acts as an intermediary between the User and the Businesses, Tu Tike is not responsible for the fulfillment of reservations, nor for the quality or conditions of services provided by the Businesses.
Tu Tike reserves the right to modify or update these Terms at any time. Modifications will be effective upon their publication on the Platform. Continued use of the Platform after the changes are posted will constitute acceptance of the updated Terms.
These Terms will be governed by and interpreted in accordance with the laws of the United States. To resolve any disputes arising from these Terms, the parties submit to the exclusive jurisdiction of the competent courts of Florida, USA, unless applicable law provides otherwise.
Any notification, communication, or notice related to these Terms will be made in writing and sent to the email address or mailing address provided by the User during registration, or to the address that Tu Tike may determine in the future.
- Complete Agreement: These Terms constitute the complete agreement between the User and Tu Tike regarding the use of the Platform and supersede any prior agreements, whether oral or written.
- Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force.
- Waiver: The failure to exercise or apply any right or provision of these Terms will not constitute a waiver of that right or provision.
